What Is a Family Law Appeal?
In the criminal justice system, an appeal may reopen a case for reevaluation from the court. For some family law cases, an appeal can do the same thing. Some family law cases involving child custody or high net worth may proceed on questionable grounds, or there could be evidence missing from the case.
The court needs a lot of detailed information to determine your case, and every document or action can make a significant difference in the outcome. If a legal mistake or another issue negatively impacts a verdict, you could face hardship, or your children could be put in an unsafe environment.
To qualify for a family law appeal, there must be evidence of:
- Harmful errors
- Abuse of discretion
- New evidence
Fraud during property division, concealment of evidence, or abuse of discretion from the judge are serious issues that should be addressed. These factors could significantly impact your case and could hinder the court process. The court system is built on justice and ethics, but it is also led by fallible people. The Appeals Process
If you choose to pursue an appeal, you will need to file a Notice of Appeal with the court stating your grounds and arguments. Once the notice is filed, the court will require an initial brief including other important documents and points in your case you want to bring before the court.
The other party is allowed to put their own case together and come forward with an answer to your appeal. You must provide a reply brief that addresses any questions or concerns brought forward by the other party. Once all replies are submitted to the court, the case will proceed to the oral arguments stage at the court of appeals in your district.
Floridians must file an appeal within 30 days of the final judgment.
