What Are the Advantages of a Postnuptial Agreement?
Postnuptial agreements provide a married couple with more control over their assets and property if their marriage dissolves or one spouse passes away unexpectedly.
The issues handled by a postnuptial include:
- Which spouse will receive what share of the property
- Which spouse will pay spousal support, the duration of the support, and the amount to be paid
- Which spouse is responsible for certain debts, such as loans, credit cards, and mortgages
- Which spouse owns the rights to life insurance and other such policies
Remember, you will need to make a full financial disclosure should you wish to create a postnuptial agreement. You will also need to provide an affirmation, since this is legally binding. This serves an important purpose, since it protects the spouses should one try to hide their wealth to prevent it from being accounted for in a divorce settlement. You are not, however, obligated to sign an agreement that you are not entirely comfortable with.
