Mothers' Rights

Mothers’ Rights Attorney in Florida

Over 100 Years of Combined Experience for Florida Mothers

A dispute involving your child may extend well beyond time-sharing. Paternity, child support, relocation, parental responsibility, and safety concerns can shape the legal framework your family needs. We help Florida mothers understand how these issues connect and what steps they may take next.

We begin by reviewing the current parenting arrangement, existing court orders or agreements, the child’s circumstances, and your immediate objective. Whether you’re starting a case, responding to a petition, or seeking to change an order, we can identify the legal issues that need attention.

Discuss your circumstances with our Florida family law attorneys. Call (800) 822-5170 to request an appointment.

How Florida Law Addresses Mothers’ Parental Rights

Florida courts decide parental responsibility and time-sharing according to the best interests of the child. The law doesn’t automatically favor either parent based on gender. It includes a rebuttable presumption that equal time-sharing serves a child’s best interests, but that presumption may be challenged with evidence related to the statutory factors and the family’s circumstances.

Shared parental responsibility is generally ordered unless the court finds that it would be detrimental to the child. Parental responsibility concerns who makes significant decisions about education, health care, and other aspects of the child’s life. Time-sharing determines when the child resides with or spends time with each parent.

A Florida parenting plan commonly addresses:

  • Decision-making responsibilities for the child
  • Regular weekday and weekend schedules
  • Holidays, vacations, and school breaks
  • Transportation and child exchange arrangements
  • Communication between each parent and the child

A mothers’ rights lawyer in Florida can present evidence about the child’s needs, each parent’s involvement, practical scheduling, decision-making, and safety. The outcome depends on the evidence and the best-interests factors that apply to the case.

Time-Sharing, Support, Paternity, & Relocation

Parenting disputes often involve several related proceedings or requests for relief. We represent clients in child custody, child support, and paternity-related cases, helping them understand how one issue may affect another.

Child Support

Child support proceedings may involve establishing an initial obligation, enforcing unpaid support, or requesting a modification. Income, time-sharing, and expenses such as health care, child care, and education may be relevant. The amount and allocation of support depend on Florida law and the financial information presented.

Paternity

For a child born outside marriage, a paternity proceeding can establish legal parentage and address support, parental responsibility, and time-sharing. Establishing biological parentage alone doesn’t necessarily create a complete parenting schedule, so the requested court orders matter.

Relocation

Florida relocation law generally applies when a parent proposes moving the child’s principal residence at least 50 miles from the current principal residence for 60 consecutive days or longer, subject to statutory exceptions. If the parents agree, their written agreement generally addresses consent, time-sharing, and transportation. If they don’t agree, the parent seeking to relocate may need court approval before moving the child.

Enforcement & Modification

An existing order remains in effect even when the current arrangement is no longer working. Enforcement may be appropriate when a parent isn’t following a parenting plan or support order. Modification generally requires a substantial and material change in circumstances and a showing that the requested change serves the child’s best interests.

Domestic Violence & Child Safety Concerns

Immediate safety needs may require a different response from a long-term parenting or support dispute. Domestic violence concerns can affect parental responsibility, time-sharing, exchanges, and requests for temporary or final protective relief. A domestic violence injunction is a court order intended to restrict prohibited conduct. When legally appropriate, it may also include temporary provisions involving the child.

Depending on the evidence and applicable orders, a court may consider supervised time-sharing, limited contact, or a safe child exchange location. These remedies aren’t automatic. We review current orders, reported conduct, available documentation, and immediate safety needs to determine which legal process may apply.

What to Organize Before Your Appointment

You don’t need to resolve every detail before speaking with a mothers’ rights attorney in Florida. Gathering records already available to you can clarify the status of your case and help us understand your immediate priorities.

Useful information may include:

  • Existing court orders, parenting plans, and written agreements
  • Relevant messages, emails, and records of disputed events
  • School, medical, and child care information
  • Child support payment records and financial documents
  • A timeline of parenting arrangements and significant changes
  • Police reports, injunction paperwork, or other safety documentation

If you have an urgent safety concern, communicate it clearly when requesting an appointment. The appropriate response may depend on whether a case is pending, an order is already in place, or immediate protective relief is being considered.
