Adoptions for Same-Sex Couples
Before same-sex marriage was legalized across the nation, Florida law banned same-sex couples from adopting. Now, it has been declared unconstitutional for same-sex couples to be denied the right to adopt children. However, because laws pertaining to the LGBTQ+ community are constantly changing and evolving, it can be extremely difficult to get through the adoption process smoothly as a same-sex couple.
LGBTQ+ couples are only permitted to adopt in Florida if they are legally married. Single adoptions by an LGBTQ+ parent must use either a private agency or the Florida Department of Children and Families (DCF). Through the DCF, the hopeful parent will attend classes, participate in interviews, questionnaires, and a home visit before he or she is found eligible to adopt. Although adoptions through private agencies are typically not so scrupulous, they are often more costly.
