Adoption Options for Same-Sex Couples in Florida
Same-sex couples do not have exactly the same adoption rights as people who do not identify with the LGBTQ+ community. For example, they may be required to go through additional steps and overcome new obstacles when trying to adopt while unmarried. No matter your familial situation, you can trust in our Orlando family lawyers to assist you with the adoption process. Using our 80+ years of combined legal experience, we are confident we can find a solution that allows you to fulfil your wish of starting a family through adoption.
There are primary adoption methods that may be used by a LGBTQ+ couple or individual in Florida:
- Joint adoption: A married LGBTQ+ couple in Florida can adopt a child together through joint adoption processes identical to the legal process for opposite-sex couples. Most adoption centers run in full or in part by the Florida state government do not permit unmarried same-sex couples to adopt the children they house or supervise.
- Single adoption: The Florida Department of Children and Families (DCF) is permitted to allow single LGBTQ+ parents to adopt through their agency. Private adoption agencies can also approve adoptions for single LGBTQ+ parents, or for just one member of an unmarried same-sex couple. This may cause complications later on when it comes to child custody rights that arise during a divorce.
- Second-parent adoption: When a member of a same-sex couple in Florida already has a child from a previous adoption or natural birth, they can permit their same-sex partner or spouse to adopt their child through second-parent adoption.
