Supportive Counsel You Can Rely On

Pensacola Condo & Homeowners Association Attorneys

Resolving Disputes Between Home/Condo Owners and Their HOAs

A Homeowners Association (HOA) is meant to maintain a safe and comfortable environment for the entire community. Unfortunately, HOAs are sometimes more interested in preserving things as they are than making accommodations for new residents and changing trends. Condo and homeowners who have no intention of disturbing their neighbors can still be bothered by aggressive HOAs that want to extend beyond their actual authority.

If you have been receiving complaints or notifications from your HOA, contact The Virga Law Firm, P.A. to speak with our experienced property owner lawyers in Pensacola. We can help you deal with an aggressive and/or manipulative HOA.

You have rights as a condo or homeowner. Call (800) 822-5170 to arrange a consultation at our firm.

Who Is the HOA?

HOAs are usually made up of volunteers and community members. Many of these members are well-meaning people who want to help their community. Unfortunately, some HOA members start to abuse their power or believe the HOA has more authority than it really does.

Situations where you may need to take legal action against an HOA include:

  • Being charged unreasonable fees
  • Adhering to rules the HOA has no authority to institute or enforce
  • Arguments over common areas
  • Instances of discrimination and harassment
  • Providing certain residents with privileges not afforded to other residents
  • Failing to enforce rules on neighbors that are causing disturbances

An Attorney Can Help You Fight Back

No one wants to create an antagonistic relationship with their HOA, which is why we try to help our clients reach compromises whenever possible. However, when an HOA is being unreasonable or acting in a way that is completely unacceptable, such as enforcing discriminatory policies, we will use all of our resources to push back against them.

Just because the HOA is enforcing rules that were included in your CC&R terms does not mean they have a right to enforce those rules. A court can review this agreement and rule on whether or not the rules included are constitutional.
