Alimony is the money paid from the more affluent spouse to the other, to maintain their lifestyle post-divorce. In Florida, one type of spousal maintenance is temporary alimony. Temporary alimony is awarded during the divorce process, which is why it is sometimes called alimony “pendente lite,” meaning while the divorce is pending.

Understanding Temporary Alimony

Under Florida law, there are 5 different types of alimony: temporary, bridge-the-gap, durational, rehabilitative, and permanent. A court may award multiple types of alimony, depending on the financial circumstances between divorcing spouses. If one spouse is suffering unnecessarily from a reduced income during the divorce, temporary alimony may be awarded to the less affluent spouse to ease the burden. Temporary alimony, under Florida Family Law § 54.01, is useful for the short-term relief of a divorcing spouse. The funds are intended to be used for living expenses, food, clothing, housing, and other needs. Once the divorce is finalized, temporary alimony payments end.

Awarding alimony payments involves a number of factors, including:

  • The standard of living the spouses enjoyed during the marriage
  • The length of the marriage
  • Financial resources of each spouse
  • Earning capacity of each spouse
