Destin Contested Divorce Lawyers

The Virga Law Firm Can Help

Let’s face it, when a couple is considering divorce, it is usually because they cannot get along or agree on things in their marriage. So, it should come as no surprise that agreeing on the terms of divorce could cause similar discord. A contested divorce is that in which the spouses cannot agree on one or more of the terms of their divorce; it also applies to situations in which one spouse does not want a divorce at all.

Our team of Destin contested divorce attorneys knows the ins and outs of divorce law in Florida and can help you throughout the legal process, so you can focus on rebuilding your life as separate entities.

Contested Divorce: The Process

The process of contested divorce is more labor-intensive, time-consuming and emotionally draining than uncontested divorce. The process involves several steps, including:

  • Filing a petition: One party (the petitioner) will have to file for divorce through a divorce petition. The petition will then be reviewed by a judge before being served to the other party (the respondent). The respondent has a specific number of days to respond to the petition.
  • Discovery phase: Both parties will have to collect the information pertinent to the divorce, such as finances, custody and child support stipulations, assets, etc.
  • Mediation: If a couple can reach an agreement without going to court, the mediation process can be used to lessen the time it will take to complete the process. In mediation, both parties meet with their representation to discuss, and hopefully finalize, custody arrangements, child support or alimony, and asset division without the need for a judge.
  • Trial: This is a last resort and occurs when the spouses cannot ultimately come to an agreement on the terms of their divorce, at which point the court determines everything they cannot agree upon, including custody and finances, with confidence that things are divided fairly and with good reason.
