- Filing a petition: One party (the petitioner) will have to file for divorce through a divorce petition. The petition will then be reviewed by a judge before being served to the other party (the respondent). The respondent has a specific number of days to respond to the petition.

- Trial: This is a last resort and occurs when the spouses cannot ultimately come to an agreement on the terms of their divorce, at which point the court determines everything they cannot agree upon, including custody and finances, with confidence that things are divided fairly and with good reason.
