Who Can File Chapter 7 Bankruptcy?

You may qualify to file Chapter 7 bankruptcy in the state of Florida if the following are true:

  • You are a property-owning individual or business entity in the United States. (Permanent residents who are not naturalized citizens may also file.)
  • You have not been given a bankruptcy discharge in the past 6 – 8 years.
  • You could not realistically meet the requirements for a repayment plan under Chapter 13.
  • You are not filing bankruptcy as part of an incorporated entity.
  • Your average income over the 6 months prior to filing bankruptcy is lower than or equal to the median in your region.
  • Your disposable income is not enough to repay at least a significant portion of your debts through a 5-year, Chapter 13 repayment plan.
  • The court does not have reason to think you are declaring bankruptcy as a way of defrauding your creditors. (They may suspect foul play if you are found to have lied about your personal information or financial obligations on a credit application, sold assets to family and friends for an unfair price, hid money from a business partner, or engaged in any other suspicious behavior.)

What Is the Chapter 7 Bankruptcy Process Like?

Achieving Chapter 7 bankruptcy discharge may take a while, but you can navigate the process with greater ease by contacting a Florida bankruptcy attorney as soon as possible and receiving vital counsel regarding your case.

After connecting with an experienced legal professional and determining together that bankruptcy truly is the best course of action for you, you and your legal representative will file a petition for bankruptcy with the proper court in your area. After filing the court will contact your creditors and call a meeting in order to evaluate the legitimacy of the information you provided on your bankruptcy forms. (This will likely be the only time you are required to go to court, unless a creditor contests your bankruptcy petition.)

Once the creditors meeting is over, the trustee in your case may require you to surrender any non-exempt property you have or the total cash value thereof. After this point, the court will officially discharge your debts and your bankruptcy will be official. This process typically takes between 4 and 6 months, depending on the complexity of your case.

You may also have to complete credit counseling before or after your bankruptcy discharge with a United States Trustee-approved agency.
